1. Acceptance of These Terms

By engaging Eureka Claims, submitting an enquiry, signing a Letter of Authority, or otherwise authorising us to act on your behalf, you confirm that you have read, understood, and agree to these Terms of Service.

2. Scope of Authorisation

By appointing Eureka Claims, you authorise us and our authorised employees, contractors, or agents to:

  • Investigate, verify, and recover any unclaimed money or assets held in your name, including associated interest or earnings.

  • Conduct all necessary searches, enquiries, and procedures required to identify and recover such funds.

  • Obtain, request, provide, and share information required to progress and finalise claims, including personal identification and supporting documentation.

  • Request information from government bodies, financial institutions, custodians, and other third parties as required for claim processing.

This authority remains in effect unless revoked by you in writing.

3. Client Responsibilities

You agree to:

  • Provide accurate, complete, and authentic identification and supporting documentation.

  • Respond promptly to reasonable requests for information or clarification.

  • Accept responsibility for delays or complications caused by incorrect, incomplete, or misleading information supplied by you.

You confirm that you are of sound mind, acting voluntarily, and are not under the care of a legal guardian or subject to an active Enduring Power of Attorney (unless disclosed in writing).

4. Privacy & Data Use

You consent to Eureka Claims collecting, using, and disclosing your personal information solely for the purpose of investigating, verifying, and recovering unclaimed funds.

All information is handled in accordance with applicable Australian privacy laws and is shared only with relevant authorities, custodians, or institutions for verification and claim purposes.

5. Fees & Payment

  • Eureka Claims charges a service fee of 20% of the total amount recovered (excluding GST, if applicable).

  • Recovered funds may be received via EFT or cheque into Eureka Claims’ designated account for processing.

  • After deduction of the agreed service fee, the remaining balance is transferred to your nominated bank account.

  • A tax invoice will be issued upon completion of the claim.

If recovered funds are paid directly to you or your representative, you agree to pay Eureka Claims the agreed service fee within seven (7) days of receipt.

6. Exclusivity & Revocation

By appointing Eureka Claims:

  • Any prior appointment of another agent or representative in relation to the same claim is revoked.

  • Eureka Claims is authorised as the sole representative for the recovery of the identified funds.

  • You agree not to appoint another party for the same claim without first providing written notice to Eureka Claims.

If you revoke this authority or attempt to pursue the claim independently after work has commenced, Eureka Claims remains entitled to the agreed service fee as compensation for work performed and administrative costs incurred.

7. No Guarantee of Recovery

While Eureka Claims undertakes thorough investigations, recovery outcomes depend on third-party authorities and institutions. No guarantee is made that funds will be located or recovered.

8. Compliance & Legal Declarations

You acknowledge that:

  • All information provided must be true, complete, and accurate.

  • It is an offence under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 to provide false or misleading information.

  • Eureka Claims relies on the accuracy of your information to verify and recover funds.

9. Governing Law

These Terms of Service are governed by the laws of Australia. Any disputes shall be subject to the jurisdiction of Australian courts.
